This privacy policy (the “Privacy Policy”) applies to “Personal Information” (defined in Section 1 below) that Rose Ventures III, Inc., Granite 1200, LLC, and their parent, affiliates, subsidiaries or other operating business divisions (collectively, “Company,” “we,” “us,” or “our”) may collect from persons (“you” or “your”) through your access of the www.1200lakeshore.com website, or any mobile or digitally available versions thereof (collectively, the “Site”).

 

The purpose of this Privacy Policy is to inform you about the types of Personal Information we gather about you when you visit the Site, Personal Information we may receive from third parties related to your interaction with the Site, how we may use that Personal Information, whether we disclose that Personal Information to anyone, and the choices you have regarding our use of such Personal Information. This Privacy Policy does not cover information that is exempted from privacy policy notification requirements, including information about employees, contractors, job applicants and information processed exclusively in the context of a business person acting in a business capacity.

 

This Privacy Policy applies solely to information collected by Company. This Privacy Policy does not apply to other websites or applications that are accessible through this Site, including but not limited to any third party websites such as RENTCafé. BY ACCESSING, BROWSING, OR OTHERWISE USING THE SITE, YOU EXPRESSLY CONSENT, WITHOUT QUALIFICATION, TO THE COLLECTION, USE AND DISCLOSURE OF INFORMATION, INCLUDING PERSONAL INFORMATION, AS DESCRIBED IN THIS PRIVACY POLICY. 1. PERSONAL INFORMATION WE MAY COLLECT

 

Types of Personal Information. We collect, process, and store various types of Personal Information.  For purposes of this Privacy Policy, “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household.  It does not include de-identified or aggregate information, or public information lawfully available from governmental or other public records.

 

Personal Information we collect may include:  your name, email addresses, postal addresses, postal codes, user Internet Protocol (IP) addresses, social security/insurance number, driver’s license number, prior addresses, monthly rent paid at prior residences, employers, job titles, income, telephone numbers, credit card information, bank account information and routing numbers, date of birth, gender, age, marital status, user name and password (if you choose to become a registered user of the Site, or our products and services, if any), emergency contact information, information about your pets, information about your vehicles including license plate numbers, and other information either desirable or necessary to provide quality services to our residents and visitors.  We may also collect information about you such as your use of the Site and communication preferences.

 

Social Media Platforms. We may maintain social media accounts for 1200 Lakeshore Apartments on platforms such as Facebook, Instagram, X (Twitter), or other third party social media or messaging platforms. When you visit, like/comment, or otherwise interact with our accounts on these platforms, the third party provider who hosts the platform will have its own privacy policy that will govern the collection, use, and processing of your Personal Information when you access or interact with the applicable platform. These third parties may thereafter provide us with your Personal Information and we will maintain such Information in accordance with this Privacy Policy. Additionally, you may, in certain cases directly provide us with your Personal Information while interacting with our social media accounts on these third party platforms in which case our obligations with respect to the use and processing of that Personal Information will be in accordance with this Privacy Policy.

 

Cookies and Other Technologies. Company may in the future use cookies to customize content specific to your interests and track your use of the Site. “Cookies” are text files that are placed on your computer and may be used to store your personal information. In addition to cookies, Company may use other now known or later developed technologies, to assist Company in observing the behavior of users visiting the Site. These technologies access individual user information, but the information is used only to compile aggregated statistics about the Site’s usage.

Specifically, this Site may in the future use Google Analytics (or other similar tracking technology). Google Analytics is a web analytics service provided by Google, Inc. (“Google”), that would be utilized to assist Company in understanding how the Site is used. Google Analytics would place cookies on your computer that would generate information that we may select about your use of the Site, including your computer’s IP address. We will provide notice (such notice may either be posted on the Site or sent via email) to active registered users of the Site should we initiate our use of cookies by Google Analytics.   • To establish and maintain your user account or profiles (such as “Resident” or “Applicant” profiles) related to the Site, or as such accounts or profiles may link to third party sites (as may be used for payments, applicant identity verification, and etc.)
  • To maintain the security of the Site and physical properties, and to prevent fraud
  • To facilitate your login to the Site, or to third party identity or access management providers
  • To provide you with information about available units, pricing, amenities, and other details about 1200 Lakeshore Apartments or our other properties
  • To communicate with you about the Site, including updates to this Privacy Policy, announcements, security alerts, and support and administrative messages
  • To send you marketing and promotional communications related to our properties or other services
  • To respond to your feedback, questions, and concerns about the Site or any of our physical properties
  • To understand your needs and interests in order to personalize aspects of the Site for you

Other Purposes. In addition to the above, we may also use your Personal Information:

  • To comply with applicable laws, lawful requests/subpoenas, any legal or administrative proceedings, and in response to requests from government agencies or authorities

There may also be certain instances where we may have to use your Personal Information for some other purpose or reason which may not be covered in this Privacy Policy. In such an instance, we will only use, share, or process your Personal Information with your prior consent.

We may share your Personal Information with the following entities or third parties and as otherwise may be described in this Privacy policy, or as noticed to you at the time of collection:

 

Corporate Entities.  We may share your Personal Information with our corporate parent, affiliates, and subsidiaries. These corporate entities may only use Personal Information in accordance with this Privacy Policy.

 

Assignment/Sale of Company. We may share Personal Information with any person to whom we transfer any of our rights or obligations under any agreement, or in connection with a sale, merger or consolidation of our business or other transfer of our assets, whether voluntarily or by operation of law, or who is otherwise deemed to be our successor or transferee.

 

Third Party Service Providers. We may share your Personal Information with third party service providers or individuals that provide services on our behalf or in connection with operation or marketing of the Site, or any of its features that you may use (such as making rent payments). These third parties may use your Personal Information only as authorized by us and are prohibited from using or disclosing your Personal Information for any other purpose, other than as otherwise stated in this Privacy Policy. In certain cases, you may leave our Site when clicking on a link or using a feature on our Site that connects to a portal or service hosted by a third party service provider. In those situations, the applicable privacy policy of the third party will apply to the collection, use, or processing of your Personal Information.

 

Advertising Partners. We may share your Personal Information with third party advertising companies (e.g., Zillow, Redfin, and etc.) in order to display advertisements for the Site or our properties through these companies’ platforms.

 

Government or Regulatory Agencies.  We may share your Personal Information whenever required by law or in response to lawful requests from law enforcement or regulatory agencies.

4. HOW PERSONAL INFORMATION IS PROTECTED

 

We use commercially reasonable efforts to implement appropriate technical and organizational safeguards to protect against unauthorized or unlawful disclosure or processing of Personal Information and against accidental or unlawful destruction, loss, alteration, or access to Personal Information.

 

We are committed to using data security and access controls (including access to our physical properties) that are aligned with industry standards and best practices along with retaining internal and external resources and expertise in testing, monitoring, and maintaining these controls. However, despite our efforts to maintain security of the Site and the safety of our physical properties, the risk of a data breach or physical security breach will always remain and as such we do not guarantee the security of your Personal Information.

5. YOUR PRIVACY CHOICES

Access, Review or Update Your Personal Information. If you have a registered account profile on our Site, you may always review and update your Personal Information or contact information in your account profile by logging into the account or otherwise contacting us by any of the methods identified in Section 9 of this Privacy Policy. With some exceptions, you have the right to see what Personal Information we hold about you. We can help you identify what records we might have about you. We may need to confirm your identity before providing you with this access, and if we cannot verify your identity with the degree of certainty required, we will not be able to respond to your request.  If we cannot give you access, we will inform you within thirty (30) days of receipt of your request and provide you with a reason, as best we can, as to why we cannot give you access.

 

Opt-out of Marketing Communications. You may receive emails (or text/SMS messaging, as may be offered to you in the future to opt-in and accept provided any disclosures of applicable charges are identified by us in advance) from Company for a variety of reasons. We respect your desire to manage email and text correspondence. If you have an account profile on the Site, you can select your preferences through your account settings. You can also manage your receipt of certain types of communication by following the instructions included in the email we send you. Please note that, even if you unsubscribe from certain email correspondences, we may still need to email you with information relating to your unit, our management of our properties, and other important transactional or administrative information.

 

Cookies & Browser Web Storage.  We may in the future initiate our use of Google Analytics, or other third party provider technology that may track your browsing activity on our Site. Generally speaking, your browser should let you remove or reject cookies and you will need to follow the instructions in your browser settings. Many browsers accept cookies by default until you change the settings. Some features of our Site may not work properly if you set your browser to disable cookies. You should also have the ability to clear cookies from your browser and free up browser web storage should you wish.

CALIFORNIA RESIDENTS’ RIGHTS. The California Consumer Privacy Act, as amended (“CCPA”) may apply to California residents whose Personal Information is collected by landlords of a certain size or that meet other criteria. While we do not believe the CCPA applies to Company as of the last update of this Privacy Policy, we still want to confirm our commitment to granting California residents the below rights with respect to their Personal Information. These rights are subject to certain exceptions, including without limitation, for Personal Information subject to the Fair Credit Reporting Act and the Gramm-Leach-Bliley Act. If you exercise any of the rights below or as otherwise afforded to you by the CCPA (should we trigger compliance with the CCPA in the future), we will continue to treat you fairly.

 

Right to request disclosure of the following information we have collected about you:

  • The categories of Personal Information we have collected about you.
  • The categories of sources from which we collected the Personal Information.
  • The business or commercial purposes for which we collected the Personal Information.
  • The categories of third parties with which we shared the Personal Information.
  • The specific pieces of Personal Information we collected about you.
  • The categories of Personal Information (if any) that we have sold about you, the categories of third parties to which we sold that information (if any), and the category or categories of personal information sold to each third party (if any).

Our responses to any of the above requests will cover the 12-month period preceding our receipt of the request.

 

Right to request the deletion of Personal Information we have collected from you:

 

Upon your request and our verification of your identity, we will delete the Personal information we have collected about you, unless a relevant exception to the right to deletion applies.

6. INTERNATIONAL DATA TRANSFERS

 

The Company is headquartered in the United States and does not at this time conduct any service or manage any properties outside the United States. From time to time, the Company may utilize a third party service provider which is based outside the United States to assist with optimization or improvement of the Site. In such a case, your Personal Information may be transferred outside the United States to the location of the applicable third party. Such third party will only use or process your Personal Information in accordance with this Privacy Policy and for no other purpose.

 

If you reside in a location outside the United States and use the Site, you expressly consent to the transfer of your Personal Information outside your country of residence. Furthermore, if you reside outside of the United States and choose to access the Site you remain solely reasonable for compliance with the local laws of your country of residence (as applicable) including, without limitation, any laws, regulations, or rules regarding the transmission of your Personal Information or any other data exported to the United States or from the country in which you reside.

7. PERSONAL INFORMATION OF MINORS

 

Our Site is not intended for children and is only directed to individuals who are 18 years of age or older. Minors under the age of 18 are not allowed to use the Site and we do not knowingly collect Personal Information from minors.  We may collect Personal Information of minors, provided by parents or guardians, in connection with the application and rental of a unit, or the provision of property management services.  If we discover that we have collected Personal Information of a minor without the consent of a parent or guardian, we will delete it.

8. CHANGES TO OUR PRIVACY POLICY

 

The Company may modify or amend this Privacy Policy from time to time. Any changes will be effective upon our posting of the applicable changes and/or implementation of the new changes on the Site. We will also update the Privacy Policy’s effective date once the new changes to the Privacy Policy have been posted.  In certain cases, you will be notified via email or by a separate notice posted on the Site. Your continued use of the Site after the posting of any modified Privacy Policy will indicate your acceptance of the new terms of the modified Privacy Policy.
